I'm not sure what OS your Touch is running, but that's actually a prety difficult icon to remove in OS 3.x.x. Here's something that may work:

  • Poke the "Settings" icon
  • Select "General"
  • Select "Restrictions"
  • If there is a passcode, enter it
  • Ensure that the slider next to "Installing Apps" is set to "on"

If I understand your question, you need to update the iPod touch to OS 2.0 or higher to have access to the App Store directly on the iPod. The iPod touch 1st gen originally shipped with OS 1.x and therefore did not have an AppStore icon ie could not access the AppStore.

if you've got OS 2.x or later installed, the AppStore icon should appear on one of your application pages.

so if you're still running OS 1.x on your iPod touch, just go to Apple's website and buy the upgrade to OS 3.x - it's only $5 - if I recall, they originally charged $10 to upgrade from OS 1.x -> 2.x, so you already saved yourself money by not updating earlier :) well worth the upgrade in any case if you're still on 1.x
