restore problem, jailbrake problem?

Hi

it seems that i cant restore the ipod, the ipod is surly jailbroken, when i try to restore it always complain about error 40, some said the the jailbrake has damage the baseband, i dont know or the ipod is somehow locked, i tried various method , tried to jailbrake it again but nothing seems to work. any ideas?
